Labor certification, often referred to as PERM (Program Electronic Review Management), is a process where the U.S. Department of Labor (DOL) certifies that there are not enough qualified U.S. workers available to fill a specific job and that hiring a foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers. This certification is a crucial step in the process for employers seeking to sponsor foreign workers for permanent residency (Green Cards) in the United States.

Rules and Regulations apply as such during the process. We will help the employer through most of the process. A prevailing wage will be requested in the PERM Labor Certification process. The employer bears the burden of proving that they have met all the requirements to obtain a certification for the future work position. The Immigration and Nationality Act (INA) requires that the hiring of a foreign worker will not adversely affect the wages and working conditions of U.S. workers comparably employed. To comply with the statute, the Department's regulations require that the wages offered to a foreign worker must be the prevailing wage rate for the occupational classification in the area of employment.
